Personal data processing information
Information provided under Article 5(5) of Law of the Republic of Belarus No. 99-Z of 7 May 2021 “On Personal Data Protection”. Version of 3 October 2026. This is an English translation; in case of discrepancy, the Russian version prevails.
1. Operator
Advocate Dzianis (Denis) Andreevich Komar, member of the Brest Regional Bar Association, Legal Consultation Office of Pinsk District and the City of Pinsk, 25 Lenina Street, office 10, Pinsk 225710, Belarus. Email: pinskadvokat@gmail.com, phone: +375 29 136-17-00.
2. Purposes of processing
Reviewing a request submitted through the form on advokat-pinsk.by; contacting the person who submitted it in order to reply, arrange a consultation and conclude a legal assistance agreement; and sending that person a confirmation that the request has been received and an offer of a date and time for a consultation, using the contact method stated in the request.
3. Personal data processed
Name, phone number, email address, the information set out in the request, details of the messenger account linked to the phone number provided (Telegram, Viber, WhatsApp), and the date and time the request was submitted.
4. Period of consent
One year from the date the request is submitted. If a legal assistance agreement is concluded, further processing of personal data takes place in connection with the performance of that agreement in accordance with the legislation on the Bar.
5. Processing operations and methods
Collection, systematisation, storage, use and deletion of personal data. Processing is carried out both by automated means and without them.
A request submitted through the website is sent to the advocate via Telegram and to the email address pinskadvokat@gmail.com, and is processed automatically on the advocate’s computer: the applicant’s details are matched against the advocate’s schedule in order to offer a consultation time, after which the applicant receives a message confirming receipt of the request by email, via Telegram from the advocate’s account, or by SMS. Automated processing does not produce legal effects for the applicant. The text of the request is not included in the calendar or in automated messages.
6. Service providers and cross-border transfer
The following services are used to receive requests, contact applicants and schedule consultations: Cloudflare (Cloudflare, Inc.) — website hosting and request forms; Telegram (Telegram Messenger Inc.), Viber (Rakuten Viber), WhatsApp (WhatsApp LLC / Meta Platforms) — request notifications and correspondence; Gmail (Google LLC) — email; iCloud (Apple Inc.) — calendar, SMS and iMessage from the advocate’s phone; the mobile operators of the applicant and the advocate — SMS delivery. The servers of these services may be located outside the Republic of Belarus, including in countries that do not ensure an adequate level of protection of the rights of personal data subjects (for example, the United States). In that case there is a risk that the protection of personal data, including its confidentiality, will not be ensured to the extent provided for by the legislation of the Republic of Belarus, and that authorities of a foreign state may gain access to it.
If you send the advocate documents or information about your matter via a messenger or email on your own initiative, they are transmitted through the services listed above on the same terms. Documents containing information about health, criminal record or other particularly sensitive information are better handed over in person, or the method of transfer should be agreed with the advocate in advance.
Personal data is not disclosed to third parties except as required by law. Information communicated to the advocate in connection with legal assistance is protected by advocate–client privilege (advocate’s secrecy).
Your rights and how to exercise them
A person who has submitted a request through the website form has the right to:
- withdraw consent to the processing of personal data at any time without giving reasons (Article 10 of the Law);
- obtain information about the processing of their personal data and request that it be corrected (Article 11 of the Law);
- obtain information about the provision of their personal data to third parties (Article 12 of the Law);
- request that the processing of their personal data be stopped and/or that the data be deleted (Article 13 of the Law);
- appeal against actions (inaction) and decisions of the operator to the authorised body for the protection of the rights of personal data subjects (Article 15 of the Law).
To exercise these rights, send the operator a written application to the address in section 1, or an electronic document in the manner provided for by Article 14 of the Law.
Consent is given by ticking the box in the website form. Without consent, a request cannot be sent through the form; in that case you can contact the advocate by phone, email, messenger or in person. Refusing or withdrawing consent has no consequences other than the termination of processing of personal data received through the website form.
